Filing a FOIL Request in Chemung County

Public Officers Law Article 6, Sections 84 through 90 gives you the right to request 72 hour booking records from the Chemung County Sheriff. Write to the Sheriff's Office at 211 William Street, Elmira, NY 14901. Your request should identify the person by name, include the approximate date of the booking, and state what records you want. Be as specific as you can.

The Sheriff has five business days to acknowledge your FOIL request. Booking records are public records, so denial of basic booking info is rare. Some details may be redacted under Correction Law Section 9. That statute restricts publication of certain inmate information online. It does not block all access, but it can mean some fields in the record are blacked out. The name, charges, and booking date are usually released. The DCJS FOIL page has additional info about requesting records at the state level.

What Chemung County 72 Hour Booking Records Show

A booking record from Chemung County includes the standard set of information. The person's full name, date of birth, and physical description. The charges at the time of booking. The arresting agency and the date and time of arrest. A unique booking number. Bail information once it is set. The court where the person is scheduled to appear, whether that is Elmira City Court, Chemung County Court, or a local town court.

Agency holds are also documented. If another county has a warrant out for the person, or if there is a parole hold from DOCCS, those show up in the booking record. The record is a point-in-time snapshot. Charges at booking may differ from what the person is eventually convicted of. Some charges get dropped, others get added. For the current status of a case, the court is the better source. The booking record just tells you what happened at the time of arrest.

Record Sealing for Chemung County Bookings

When charges are dismissed or a person is acquitted, CPL Section 160.50 seals the booking record automatically. This applies to all New York counties including Chemung. The record is removed from public access. No search tool or FOIL request will produce it once sealed. The person does not need to take any action for this to happen.

CPL Section 160.59 allows eligible people to apply for sealing of conviction records. The person files a motion with the court after completing their sentence and waiting the required period. The judge decides. If granted, the Chemung County booking record is sealed from public view. Youthful offender records under CPL Section 720.35 are confidential from the beginning. These sealing provisions mean that some bookings you search for simply will not be findable through public channels.
